An Overview of the Services and Who’s Who at Yahoo
Yahoo Inc. and all its brands listed in Section 13—including the well-known Yahoo and AOL brands—as well as the entities detailed in Sections 13 and 14 (together referred to as “Yahoo,” “we,” “our,” or “us”) are part of the Yahoo family of companies. Our brands, websites, apps, products, services, and technologies (collectively, the “Services”) are provided by the entities listed in Section 13 below. Make sure to carefully read Sections 1 to 13, 14.1, and 14.13, as these sections apply directly to you (and yes, we know legal reading isn’t the most exciting—coffee recommended).
Accepting the New Terms & Why It Matters
By using the Services, you are accepting these Terms of Service, the Community Guidelines, and any additional terms provided to you for the specific Services you use (collectively, the “Terms of Service”). Please make sure you read the Terms of Service carefully—they make up the entirety of your agreement with us. If you prefer skipping straight to the emojis and videos, just remember: using our Services means you’re agreeing to these rules.
Key Points for Users in the United States and European Union
FOR USERS IN THE UNITED STATES: SECTION 14.2 BELOW OF THESE TERMS OF SERVICE INCLUDES A BINDING ARBITRATION AGREEMENT AS WELL AS JURY TRIAL AND CLASS ACTION WAIVERS, WHICH APPLY TO ALL USERS IN THE UNITED STATES.
Additionally, in line with the European Union Digital Services Act, we must provide specific additional terms to users residing in the European Union. For all the details, see subsection 14.13.o. below. If you live in the EU and your account has been restricted as per section 14.13.o.i, you may submit a complaint using the contact methods provided in section iii. of the terms. Your complaint should include: your country of residence, your account information (name and email address), a detailed description of your complaint, and any notices we sent you regarding your account or the services used. After reviewing, we’ll let you know about any measures we plan to take to address your complaint. If the information you provide is unclear or incomplete, we reserve the right not to respond until we receive enough detail to understand your situation. Our dedicated teams are trained to assess complaints and take necessary action quickly, accurately, and without discrimination, in line with our User Charter and these Terms of Service.
How Privacy, Intellectual Property, and Your Ideas Are Handled
Our Privacy Policy tells you who we are, what information we collect from you and whom we share it with, and it also outlines your rights under data protection laws. (“Spoiler alert: we’re fans of transparency.”)
Respecting intellectual property is important to us—and to you, we hope. We expect our users to show that same respect. Yahoo may, when circumstances warrant and at our sole discretion, disable, terminate, and/or take other appropriate action regarding user accounts that violate these rules. If you believe your copyright or intellectual property rights have been infringed, please follow the instructions provided on this page.
We’re also open to feedback! By sending us any suggestion, idea, proposal, feedback, or other contribution (“Feedback”) relating to our products, services, sites, apps, or technologies, you agree that we may use this Feedback without notice, obligation, restriction, refund, or compensation. You also waive any rights (or commit not to assert them) that could exist now or in the future (including moral rights and equivalent rights) in any Feedback.
Important Limitations of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU ACKNOWLEDGE AND UNDERSTAND THAT YAHOO ENTITIES WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, TRIPLE DAMAGES OR ANY MULTIPLES OF ACTUAL DAMAGES, EXEMPLARY OR PUNITIVE DAMAGES ARISING OUT OF THESE TERMS OF SERVICE OR YOUR USE OF THE SERVICES. YAHOO ENTITIES ARE NOT LIABLE FOR LOSS OF PROFITS, REVENUE, LOST BUSINESS OPPORTUNITIES, DIMINISHED VALUE (INCLUDING ANY LOSS OR PRESUMED LOSS OF VALUE OF PERSONAL INFORMATION), OR ANY OTHER LOSS (TOGETHER, “LOSSES”) ARISING OUT OF THESE TERMS OF SERVICE, YOUR USE OR ACCESS OF THE SERVICES, INCLUDING BUT NOT LIMITED TO LOSSES RESULTING FROM OR RELATING TO: DELETION, ALTERATION, FAILED DISTRIBUTION, OR INABILITY TO STORE DATA SAVED OR TRANSMITTED THROUGH THE SERVICES; ANY RESTRICTION, SUSPENSION, OR TERMINATION OF YOUR ACCOUNT; YOUR DOWNLOADING OR SHARING (INCLUDING PERSONAL INFORMATION) THROUGH THE SERVICES; UNAUTHORIZED ACCESS TO YOUR ACCOUNT OR ANY DATA SAVED/TRANSMITTED THROUGH THE SERVICES; LINKS PROVIDED BY THE SERVICES OR THIRD PARTIES TO EXTERNAL SITES OR RESOURCES; YOUR AGREEMENTS WITH ADVERTISERS OR PARTICIPATION IN ADVERTISER PROMOTIONS FOUND ON OR THROUGH THE SERVICES; OR ANY GOODS OR SERVICES SOLD BY THOSE ADVERTISERS. YAHOO ENTITIES WILL NOT BE RESPONSIBLE FOR PROBLEMS CAUSED BY OTHERS, THIRD-PARTY MISCONDUCT OR ILLEGAL ACTS, OR CIRCUMSTANCES OUTSIDE OUR CONTROL. THESE LIMITATIONS AND EXCLUSIONS APPLY WHETHER OR NOT WE HAVE BEEN WARNED OF THE POSSIBILITY OF SUCH LOSSES, OR SHOULD HAVE BEEN AWARE OF THEM.
To the extent allowed by law—and unless otherwise stated in Section 14—Yahoo entities will not be liable in any dispute related to these Terms of Service or Services for more than the amount you paid us for the Services (so, if you’re using the free stuff, there’s not a lot to split hairs over).
