2023 Maryland Legislation Of Interest To The Carroll County Observer

House Bill 119 and cross filed with Senate Bill 199: Primary and Secondary Education – Comprehensive Health Education Framework – Established

Requiring the State Department of Education, in collaboration with the Maryland Department of Health, to develop a comprehensive health education framework; requiring each county board of education to create an age-appropriate curriculum that is consistent with the comprehensive health education framework; requiring each county board to establish a method by which a parent or guardian may opt out of certain topics, subject to certain requirements; etc.

Altering, in 2024, the date of the statewide primary election and the primary election for municipal offices in Baltimore City to the third Tuesday in April.

Senate Bill 845 (cross filed with HB 933): End–of–Life Option Act (The Honorable Elijah E. Cummings and the Honorable Shane E. Pendergrass Act)

Authorizing an individual to request aid in dying by making certain requests; establishing requirements and prohibitions governing aid in dying, including requirements related to requests for aid in dying, consulting physicians, mental health assessments, the disposal of drugs prescribed for aid in dying, health care facility policies, and the effect of aid in dying on insurance policies; authorizing a pharmacist to dispense medication for aid in dying only to certain individuals under certain circumstances; etc.

Repealing a requirement that certain motor fuel tax rates be adjusted in future years based on growth in the Consumer Price Index for All Urban Consumers.

House Bill 540 – Income Tax – Local Advertisement Tax Credit

Allowing small and medium-sized businesses with fewer than 50 employees to claim a credit against the State income tax for certain costs incurred during the taxable year for advertising through a news media entity based within the State, subject to certain limitations.

LEGISLATION THAT FAILED IN 2023

House Bill 359: Education – Interscholastic and Intramural Junior Varsity and Varsity Teams and Sports – Designation Based on Sex (Save Women’s Sports Act)

Requiring certain interscholastic and intramural junior varsity and varsity athletic teams or sports sponsored by certain schools to be expressly designated based on biological sex; prohibiting certain entities from taking certain adverse actions against a school or county board of education for maintaining separate interscholastic and intramural junior varsity and varsity athletic teams and sports for students of the female sex; and providing that certain individuals have the right to bring a civil action under certain circumstances.

Senate Bill 378: Public Health – Vaccinations – Minor Consent

Providing that minors who are at least 14 years old have the same capacity as an adult to consent to vaccination; authorizing minors under the age of 14 years to consent to vaccination under certain circumstances; and providing that the capacity to consent does not include the capacity to refuse vaccination for which a parent or guardian has given consent.
